Por uma maioria de 6 votos a 3, a mais alta corte do pa\u00eds barrou em definitivo a ordem executiva presidencial que pretendia restringir o direito \u00e0 cidadania autom\u00e1tica para filhos de estrangeiros em situa\u00e7\u00e3o irregular ou com vistos tempor\u00e1rios nascidos em solo americano.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Com o desfecho do julgamento, conhecido como <em>Trump v. Barbara<\/em>, permanece plenamente protegida a regra de mais de 150 anos fundamentada na 14\u00aa Emenda da Constitui\u00e7\u00e3o dos EUA: o princ\u00edpio do <em>jus soli<\/em> puro, que garante que qualquer pessoa nascida no territ\u00f3rio do pa\u00eds \u00e9 considerada cidad\u00e3 americana nativa.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>A Fundamenta\u00e7\u00e3o da Corte<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">O voto condutor foi proferido pelo presidente da Suprema Corte, John Roberts, que foi acompanhado pelas ju\u00edzas Sonia Sotomayor, Elena Kagan, Amy Coney Barrett e Ketanji Brown Jackson. O juiz Brett Kavanaugh concordou com o resultado final por fundamentos pr\u00f3prios.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Em seu texto, Roberts enfatizou que a cidadania representa \u201co direito a ter direitos\u201d e relembrou que os autores da 14\u00aa Emenda, em 1868, estenderam essa promessa de forma ampla e permanente a todos os nascidos no pa\u00eds. A maioria dos magistrados rejeitou expressamente a tese do governo de que a emenda deveria se aplicar apenas historicamente aos escravos rec\u00e9m-libertos, reafirmando o s\u00f3lido precedente hist\u00f3rico estabelecido no caso <em>United States v. Wong Kim Ark<\/em>, em 1898.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>O Impacto Social e Jur\u00eddico<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">A medida assinada pelo governo executivo pretendia fazer com que os \u00f3rg\u00e3os federais deixassem de reconhecer a cidadania de crian\u00e7as nascidas nos EUA caso nenhum dos pais possu\u00edsse o status de cidad\u00e3o ou de residente permanente no pa\u00eds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dados apresentados pelo <em>Migration Policy Institute<\/em> indicavam o tamanho do impacto caso o decreto tivesse sido validado: cerca de 255 mil crian\u00e7as nascem anualmente nos Estados Unidos sob essas condi\u00e7\u00f5es e perderiam o status legal de forma imediata.
